Missouri State Rule Sharpens Stance on Public Access Computers in Libraries
Adding to the newly instated measures that went into effect on May 30, 2023 to protect minors in public libraries, the State of Missouri has issued another set of directives specifically for public access computers within these institutions. This rule, 15 CSR 30-200.030, establishes protocols to limit access to materials classified as pornographic for minors.
This rule further defines certain key terms. "Public library" refers to a library primarily supported by public funds and designed to serve the general public. "Secretary" and "State librarian" are the Missouri Secretary of State and Missouri State Librarian, respectively. The definitions for "minor" and "public access computer" are in accordance with section 573.010 and section 182.825 of RSMo, respectively.
The state librarian, under the secretary of state's direction, will administer these procedures in accordance with the stipulated rules and applicable state laws.
Public libraries must comply with one of the two requirements laid down by the state:
Equip any public access computer with software that limits minors' ability to gain access to pornographic materials or buy internet connectivity from an ISP that provides filter services for such content.
Develop and implement a policy by January 1, 2003, that is consistent with community standards and sets measures to restrict minors from accessing pornographic materials on computers.
To ensure compliance, public libraries need to certify themselves in line with the state library's rule. They can do this by filing a certification form provided by the state library and demonstrating adherence to an internet usage policy or use of filtering software on public access computers. In the first year of certification, the filing date will be set by the Missouri State Library, and in subsequent years, the certification must be filed by the date state aid forms are required to be submitted.
Noncompliance will not be tolerated. Any "public library or public library board member, officer, employee, or trustee" not willing to submit such certification of compliance will be found noncompliant with this rule. Compliance forms, as designated by the state library, are available on the state library's website and should be filed with the State Library, located in Room 200 of the James C. Kirkpatrick State Information Center, 600 West Main Street, Jefferson City, Missouri.
These additional guidelines ensure that public libraries in Missouri maintain a safe and educationally appropriate environment for all users, especially minors, when it comes to computer usage.
